IMPORTANT NOTICE: BY ACCESSING OR USING COVERTHEGAPS.COM (“SERVICE”), YOU AGREE TO THESE TERMS, INCLUDING A MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER FOR U.S. USERS (SEE SECTION 16). IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
These Terms of Use (“Terms”) form a binding agreement between you and CoverTheGaps.com (“we,” “us,” “our”). We may update these Terms from time to time. Material changes will be posted with a revised Effective Date. Your continued use constitutes acceptance of the updated Terms.
Certain profile fields (e.g., name, display name, username, avatar, role, class affiliation) may be visible to other users or publicly accessible, including via search engines, directories, teacher rosters, and community features, as described in our Privacy Policy. By creating a profile or uploading information, you acknowledge and consent to such displays and indexing to the extent permitted by law and by your settings. Do not upload information you do not wish to be public.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, lawful purposes. You agree not to:
You retain ownership of content you submit (“User Content”). You grant us a worldwide, non-exclusive, perpetual, irrevocable, sublicensable, royalty-free license to host, use, reproduce, modify, adapt, translate, publish, perform, display, distribute, create derivative works from, and otherwise exploit your User Content in connection with operating, improving, and promoting the Service.
For content you post in the Community, Section 20 limits how long this license lasts.
You represent you have all rights necessary to grant this license and that your User Content complies with these Terms and the law. We may remove or disable any content or suspend accounts at our discretion, including to comply with legal obligations or protect users.
Feedback. If you provide suggestions or ideas, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or attribution.
Content on the Service is for informational and educational purposes only and is not professional advice (legal, medical, financial, etc.). You rely on such content at your own risk.
The Service may integrate or link to third-party services. We do not control and are not responsible for third-party services. Your use is governed by their terms and policies.
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, disclose, and share information, including public display of certain profile fields. To the extent allowed by law, the Privacy Policy is incorporated into these Terms.

Your notice must include information required by 17 U.S.C. §512(c)(3). We may remove content and terminate repeat infringers in appropriate circumstances.
We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. Beta or experimental features may be provided “as is,” may be incomplete, and may change or be withdrawn.
We may suspend or terminate your access at any time for any or no reason, including violations of these Terms. Upon termination, Sections that by their nature should survive (e.g., licenses, disclaimers, limitations of liability, arbitration) will survive.
You agree to defend, indemnify, and hold harmless CoverTheGaps.com and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your interactions with other users.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted by law.
You are solely responsible for your interactions with other users. To the extent permitted by law, you release us from claims, demands, and damages arising out of or related to disputes with other users.
Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except where mandatory local law applies.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by [JAMS/AAA] under its rules. Arbitration will take place in [Los Angeles County, California], in English, before a single arbitrator. Either party may bring an individual claim in small claims court.
Class Action Waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Opt-Out. You may opt out of arbitration within 30 days of first accepting these Terms by sending a written notice to [Insert Email/Address].
Non-U.S. users: If mandatory law in your country grants you the right to bring claims in local courts, this Section does not deprive you of those rights.
We operate from the United States. You are responsible for compliance with local laws. To the extent mandatory consumer rights apply in your jurisdiction (e.g., EEA/UK), nothing in these Terms deprives you of such rights. We do not exclude or limit liability that cannot be excluded by law (e.g., for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
You consent to receive communications electronically. We may provide notices by posting to the Service or emailing the address in your account. Legal notices may be sent to: [Insert Address] and [Insert Email].
The Community (coverthegaps.com/community) is the part of the Service where members post in English, comment, correct each other’s writing and chat with practice partners (“Community”). “Community Content” means everything you post or send there: posts and their images, comments, corrections, profile information, practice invitations and messages.
Community Guidelines. The Community Guidelines are part of these Terms. They set out what is and is not allowed in the Community, how reporting and moderation work, and how we handle Community data. Where they deal with a Community matter more specifically than these Terms, the Community Guidelines apply.
Age. You must be at least 18 years old to join or use the Community, whatever minimum age applies to the rest of the Service. We ask for your date of birth when you join, and we remove from the Community anyone we learn is under 18.
Your Community Content. Notwithstanding Section 5, the license you grant us over your Community Content ends when you delete that content or delete your community data, except for: (a) corrections you gave other members that they accepted, which stay in their mistakes journals without your name; (b) copies we keep as records of reports and moderation decisions, for the periods stated in the Community Guidelines (Community Content we removed is kept, hidden, for up to 12 months after a moderator reviewed it, so that you can appeal, and is then deleted together with the reports about it); and (c) copies in backups, until they are overwritten in the ordinary course.
Reports and moderation. Anyone may tell us about Community Content they believe is illegal or breaks the Community Guidelines: members with the Report button, anyone else through our support page. We review reports and may remove content, hide it pending review, restrict an account or remove a member from the Community. Automated tools may hide individual items; they never restrict an account by themselves.
Statement of reasons and appeals. When we remove or restrict your Community Content or your access to the Community (except a practice invitation that its recipient reported, which we withdraw without notice, as if it had gone unanswered, so that its sender cannot tell who reported it), we tell you what we did and to which content, why — including the rule of the Community Guidelines or the law concerned, when a report or a moderator’s decision names one — whether automated means were involved, and how to appeal. You may appeal any such decision through our support page, choosing “Community: reports and appeals”; a person reviews every appeal. This does not limit any other remedy available to you under applicable law.
